Do you remember the other day I wrote about the customized social media illegal?
But… there’s some changes in policy here…
Since I am a web designer and developer for at least 4 years, and in my experience, I have found many designers using the customized social media icons everywhere. The worst thing is that they have not checked with copyright lawyers about the customized social media icons and are taking a dangerous and expensive risk. A few weeks ago, I gave away one free Blogger.com blog design theme for my client who was the winner of the sweepstakes I held; however, I was kind of nervous because I knew the customized social media icons were illegal.
While designing my client’s blogger.com blog design, I needed to let my client know about the customized social media icons that were illegal. So, I had my best mind to give an excellent explanation about this and sent it to my client via email. A few hours later, my client responded back with her great understanding, I was totally relieved. We both agreed that we had to sign up an agreement form together in order to avoid a violation of the copyright infringement from social media companies. This form was considered for our safety, my client agreed to take the risk for a violation of the copyright or trademark infringement in her blog.
Personally, I spoke with my husband who happened to know more about the copyright & trademark laws. He advised me to contact my lawyer directly, I called my lawyer about the customized social media icons. My lawyer told me that signing up an agreement form between myself and my client should be more safe and it should be okay. Most importantly, if any clients disagree to take risk for violating the copyright infringement from social media companies, I would refuse to design the customized social media icons and I can use the proper social media icons. If the clients agree to take the risk, then I, as a designer, would not be responsible for any cause of any violation because all designs are only the clients’ own choices. They are their own choices, not mine as the designer, therefore releasing any legal responsibility on my part.
Good news, I am opening to design the customized social media icons in Google’s Blogger.com and WordPress. Before placing an order for the project, I require my clients to sign an agreement form with both our signatures first before designing the project. I encourage y’all to read the terms and conditions before placing an order for design packages.
If you are a professional designer for a web designing business, you need to be in contact with your lawyer about creating an agreement form between you and your clients. You also need to protect your business and – yourself. It’s for your own safety. Don’t say that I did not warn you.
